Terms & Conditions

Welcome to Childcare Check-In. These Terms of Service (“Terms”) govern your access to and use of the Childcare Check-In website and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Who We Are

Childcare Check-In is a corporation registered in Ontario, Canada. We provide childcare centres with digital tools for attendance and enrollment, and waitlist tracking.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of a childcare centre or organization to use our Services. The Services are intended for use by childcare centres and staff, not directly by parents or children.

3. Accounts & Responsibilities

  • To access certain features, you must create an account with accurate and complete information.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You agree not to share login details or allow unauthorized access to your account.

  • You are responsible for all activity under your account.

4. Use of Services

You may use our Services only for lawful purposes and in compliance with these Terms. You agree not to:

  • Use the Services in a way that violates applicable laws or regulations.

  • Upload false, misleading, or inappropriate content.

  • Attempt to interfere with or disrupt the security, integrity, or availability of the Services.

5. Children's Information

Our Services may involve the entry of limited children’s information (e.g., names, allergies) by childcare centres for attendance and enrollment purposes. Centres are solely responsible for ensuring they have obtained any necessary parental consent before uploading such information.

6. Payments & Subscriptions

  • Access to the Services requires payment of applicable fees.

  • Payments are processed securely through Wix Payments or Stripe.

  • Fees are non-refundable except as required by law.

  • We may suspend or terminate your access if payments are not made on time.

7. Intellectual Property

All content, trademarks, and software associated with the Services are the property of Childcare Check-In or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your childcare centre’s internal operations.

8. Data Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

9. Service Availability

We aim to keep our Services available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Services at any time without liability.

10. Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Childcare Check-In and its directors, employees, and affiliates are not liable for any indirect, incidental, or consequential damages, including lost profits, arising out of or relating to your use of the Services. Our total liability to you will not exceed the amount you paid for the Services in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold harmless Childcare Check-In from any claims, losses, or damages arising from your use of the Services, your breach of these Terms, or your uploading of information (including children’s information) without proper authorization.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. If you are located in the United States, you may also have rights under U.S. state or federal laws, which will apply where relevant.

14. Termination

​We may suspend or terminate your account if you violate these Terms or misuse the Services. You may also stop using the Services at any time.

15. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with a new effective date. Continued use of the Services after changes means you accept the updated Terms.
